Terms of Service

1. Acceptance of Terms

By using the Catchwerks SMS service, you agree to these Terms of Service. If you do not agree, do not use the service and reply STOP to any message you receive from us.

2. Service Description

Catchwerks is an SMS-based order intake service for business-to- business wholesale distribution. The service is provided to commercial customers of distributors that have enrolled in Catchwerks. Catchwerks is not a consumer service and is not available to the general public.

3. Eligibility

• You must have an active commercial relationship with an enrolled distributor.
• You must be authorized by the distributor and by your business to place orders on behalf of that business.
• The service is available to recipients in the United States only.

4. Acceptable Use

• Use the service only for transactional ordering with your distributor.
• Do not use the service for harassment, spam, illegal activity, or any purpose other than legitimate order placement.
• Do not attempt to bypass, manipulate, reverse engineer, or interfere with the service.

5. Service Availability

• We aim for high availability but do not guarantee uninterrupted service.
• Maintenance windows may temporarily affect availability.
• Carrier networks affect message delivery and are outside our control.

6. Message and Data Rates

Standard message and data rates from your mobile carrier may apply to messages exchanged with the Catchwerks service. Catchwerks does not separately charge recipients for SMS messages. Message frequency varies based on your ordering activity.

7. Privacy

Information handled by Catchwerks is described in our Privacy Policy, which is incorporated into these Terms by reference.

8. Intellectual Property

• “Catchwerks” and related marks are the property of Quantum Web Solutions LLC.
• The service software, content, and design are protected by copyright and other intellectual property laws.

9. Disclaimers

• The service is provided “as is” and “as available” without warranties of any kind, express or implied.
• We do not warrant that the service will be error-free or uninterrupted.
• Order parsing is automated. You are responsible for confirming order details before submitting any order.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees, if any, paid by you to Catchwerks in the twelve (12) months preceding the event giving rise to the claim. In no event will Catchwerks be liable for indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold harmless Quantum Web Solutions LLC, its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

• Either party may terminate the relationship at any time.
• Opt-out via STOP reply is immediate.
• Termination does not affect orders already submitted prior to termination.

13. Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. The exclusive venue for any dispute will be the state and federal courts located in Clark County, Nevada.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Your continued use of the service after such a change constitutes acceptance of the updated Terms.
